Profixo Ops Terms of Use

1. Your account

• Your account was created by your Customer's owner or by Profixo. It is personal to you. Do not share your login or let anyone else use your session.
• Keep your password private. Sign out on shared devices. Tell your Customer's owner or Profixo at once if you think your account has been compromised.
• Your Customer controls your role and what you can see. Your Customer can suspend or remove your access at any time.

2. Who owns what

• All data entered into Profixo Ops (applicants, employees, contacts, clients, assignments, documents, notes, and records) belongs to the Customer, not to you and not to Profixo.
• Profixo processes that data only to provide the platform, as directed by the Customer.
• You may not export, copy, or use Customer data for any purpose outside your work for the Customer, or after your access ends.

3. Sensitive information

Profixo Ops may hold sensitive personal information about applicants, employees, and clients, including identity documents, contact details, employment records, incident reports, payroll-related figures, and background-check status.

• Access it only when your role requires it and only for the Customer's legitimate business purposes.
• Do not download, screenshot, forward, or share sensitive information outside the platform unless the Customer's owner authorizes it in writing.
• Follow all laws that apply to the data you handle, including employment, privacy, and consumer-reporting laws. Profixo is not a consumer reporting agency and does not order, produce, or make decisions based on background checks. The Customer is responsible for how it uses that information.
• Views and changes to sensitive records may be logged. The Customer's owner can review those logs.

4. Messages sent through the platform

Profixo Ops can send text messages and emails on behalf of the Customer (for example, assignment confirmations and reminders). If you trigger a message, you confirm the recipient has agreed to receive it and that the content is accurate and lawful. Do not send marketing or unsolicited messages through the platform.

5. Acceptable use

You may not: enter false information into records; attempt to access data or companies you are not assigned to; interfere with the platform's security or performance; reverse engineer or scrape the platform; upload malware or unlawful content; or use the platform for anything other than your Customer's business.

6. AI features

Some features use artificial intelligence (for example, drafting, summarizing, prescreening, or answering questions from Customer records). AI output can be wrong. Review it before relying on it or acting on it, especially for decisions about people. AI features do not make employment decisions; people do.

7. Availability and changes

We work to keep the platform available and may update or change features. Planned maintenance will be communicated where practical.

8. Termination

Your access ends when your Customer removes you, when the Customer's Service Agreement ends, or if you violate these Terms. Sections 2, 3, 9, 10, and 11 survive termination.

9. Disclaimers and limitation of liability

The platform is provided "as is." To the fullest extent permitted by law, Profixo disclaims all implied warranties and is not liable to individual users for indirect, incidental, or consequential damages. Profixo's obligations to the Customer are set out in the Service Agreement.

10. Governing law

Arizona law governs these Terms. Disputes go to the state or federal courts in Maricopa County, Arizona.

11. Privacy

How we handle personal information is described in the Profixo Privacy Policy at app.getprofixo.com/privacy, which is part of these Terms.

12. Changes and contact

We may update these Terms and will show you the new version at sign-in. Continued use is acceptance.
